General Terms and Conditions (GTC) of Resin Art Zürich

All important information about my artwork, orders, and deliveries can be found in my General Terms and Conditions (GTC).

1. Validity and definitions

(1) I, Resin Art Zürich, operate under the website www.resin-art-zuerich.ch an online shop for handmade works of art made of epoxy resin. The following general terms and conditions apply to all services between you as a customer and me in the version valid at the time of the order, unless expressly agreed otherwise.

(2) For the purposes of these General Terms and Conditions, a "consumer" is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. An "entrepreneur" is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its commercial or independent professional activity.


2. Conclusion of contract and storage of the contract text

(1) My product presentations in the online shop are non-binding and do not constitute a legally binding offer.

(2) When you place an order via my website, you make a binding offer to purchase the corresponding product. The order is placed in the following steps:

  • selection of the desired product
  • Adding the product to the shopping cart
  • Checking the information in the shopping cart
  • Entering contact details, billing and delivery address
  • Selection of payment method and confirmation of the terms and conditions
  • Complete the order by clicking on «Order with payment»

(3) I will confirm receipt of your order by email. The purchase contract is only concluded with my express order confirmation.

(4) I do not save the contract text. Please therefore keep all emails and order data carefully.


3. Prices, shipping costs and delivery

(1) All prices quoted are in Swiss francs (CHF). I am not liable for value added tax, so no VAT will be charged.

(2) Shipping costs will be charged additionally and selected by you when ordering.

(3) Payment is made via TWINT, credit card or other payment methods specified in the online shop. Delivery will only take place after receipt of payment.

(4) I deliver to the address you provide within Switzerland and the EU. Deliveries outside the EU are only possible after prior arrangement.

(5) The delivery time is usually 5-7 working days after receipt of payment. If there are any delays, I will inform you immediately.

(6) The risk of loss or damage to the goods passes to you upon handover to the post office.


4. Retention of Title

The goods remain my property until full payment has been made.


5. Withdrawal

As a consumer you have a right of withdrawal. You can find the exact conditions in my Right of Withdrawal.


6. Liability

Resin Art Zürich excludes any liability, regardless of its legal basis, as well as claims for damages Resin Art Zürich and any auxiliary persons and vicarious agents. In particular, I am not liable for indirect damages and consequential damages, lost profits or other personal injuries, property damage and purely financial losses of the customer. Further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved.

Resin Art Zürich uses hyperlinks only to simplify the customer's access to other web offers. I cannot know the content of these web offers in detail, nor can I accept liability or other responsibility for the content of these websites.


7. Warranty

(1) The statutory warranty rights apply.

(2) You must notify me of any obvious defects in writing within 7 days of receipt of the goods. Otherwise, the goods will be deemed accepted.

9. Final Provisions

(1) Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) The place of jurisdiction for all disputes is Zurich.

(3) Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.

Custom-made products with resin:

  1. Custom-made products made with resin, especially in the area of ​​bridal bouquets, are individual works of art and are based on natural materials such as flowers and resin.

  2. Although I take the greatest care, unforeseen reactions may occur when using resin. The resin may behave differently than expected, resulting in changes to the appearance or structure of the artwork.

  3. Customers ordering custom resin items must be aware of the nature of the material. There is always some risk that items (especially flowers) may become discolored, deformed, or otherwise affected in the resin.

  4. I assume no liability for any damage or alteration caused by the resin or other natural materials. Customers bear the risk of any losses or changes to their custom-made products.

  5. By placing an order for a custom resin product, you agree that there is no guarantee as to the final appearance and that you assume the risk and responsibility for the product.

  6. Fine bubbles may form (which I always try to prevent and remove) or fine lines may be visible on the edge (the casting lines).

Additional information - Preserving flowers

I realized that no matter how much I explain the conservation process and all the things that can and will happen and the end result, I cannot control someone else's expectations or feelings. No matter how many times I talk and explain on my page and through social media about flowers, the possible changing of colors, bubbles, fine lines on the side, transparency in petals, there are always people who don't want to hear it or don't understand.

I do this job out of passion because I love to immortalize flowers and their beauty. It's not about taking advantage of customers or ruining their day. My intention is for you to have flowers that you can keep for the rest of your life.

A lot can happen with custom art like flower preservation. The more experience you have, the more you can mitigate these variables. But a bubble can release in the middle of curing and I can't get it out. Transparency can happen to petals, bubbles can get trapped under petals. Small "debris" from petals can move, etc.

What I will say and promise as an artist and manager is professionalism, honesty and transparency.
